Conditions of Entry

1. Information on how to enter and all prize details form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is open to Australia residents aged over 18 only. Only one entry per person is permitted. Employees (and their immediate families) of Red Earth Nominees Pty Ltd (trading as Taltarni Vineyards) ACN 005 598 318 of 339 Taltarni Road, Moonambel, Victoria, 3478, Australia (the Promoter) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Terms and Conditions. Entries are considered invalid if they're offensive and/or derogatory in any way.

4. The promotion commences at 9.00am (AEST) on 01/02/12 and closes at 5.00pm (AEST) on 30/04/12 (Promotional Period).

5. To receive a valid entry into the draw, entrants are required to describe one of their life's "sparkling moments", in 20 words or less, and submit it via the entry website (www.taltarni.com.au/sparklingmoments). Each applicant must submit their answer, name, email address and mailing address. Only entrants who meet all the requirements set out in these Terms and Conditions are eligible to win.

6. Prizes: There are 3 x major prizes consisting of a Holloway Diamonds pink diamond "cluster" on a white gold pendant with white gold chain. Each pendant is valued at AU$8,500 (total major prize value = AU$25,500.00). The minor prizes consist of 300 x (one) bottle of Taltarni Taché, along with (one) pink stopper, in a gift box, delivered to an address within Australia. Each minor prize is valued at AU$30.00 (total Minor Prize value AU$9000.00). Total prize value AU$34,500.00.

7. PRIZE DRAW: Prize draws will take place in the presence of an independent witness at Messageforce: Office 10, 899 Whitehorse Road, Box Hill, VIC 3128. There will be three minor draws. Entries for minor draws close at 8.45am (AEST) on the 29/02/12 & 01/04/12 and 5.00pm (AEST) on 30/04/12. Minor draws will be conducted at 9.00am (AEST) on 29/02/12, 01/04/12 and 01/05/12. Each Minor draw is a random selection of 100 names with a total of 300 minor prizewinners. The final draw for the 3 x Major Prizes will be drawn/selected from ALL entrants at 9.00am (AEST) on 01/05/12. The judges' decision is final and no correspondence will be entered into.

8.The “People’s Choice” will be awarded to the entry with the greatest number ofFacebook comments, recommendations and sends (shared links). In the unlikely event that there's a tie within the "People's Choice" category, the most popular entry, the winning entry, will be determined by Taltarni Vineyards. "Taltarni's Choice" will be voted on by the team at Taltarni Vineyards, with the entry receiving the most votes being awarded "Taltarni's Choice".

9. In the event that for any reason whatsoever the prizewinner does not take the prize then the prizewinner will forfeit that prize.

10. The major prizewinners will be notified via phone, email and mail within two days of the draw. The minor prizewinners will be notified via email within two days of the draw. The major prizewinners' details will also be published in The Australian on 07/05/12. The minor prizewinners' details will also be published on www.taltarni.com.au/sparklingmoments

11. Where the prize remains unclaimed, the Promoter will conduct such further draws as necessary in the presence of an independent witness on 01/08/12 at Messageforce: Office 10, 899 Whitehorse Road, Box Hill, Victoria, 3128 at 9.00am (AEST). The winner of any such unclaimed prize draw will be advised via phone and email within two days of the draw. Winners' details will be published in The Australian on 02/08/12.

12. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following:

• (a) any theft, unauthorised access or third party interference;
• (b) any recommendation or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
• (c) any tax liability incurred by a winner or Eligible Entrant; or
• (d) use of the prize.

13. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the Eligible Entrants. Eligible Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Unless otherwise indicated by you, by participating in this promotion you are agreeing to us providing you with information in relation to the services and products of Red Earth Nominees Pty Ltd (trading as Taltarni Vineyards).

14. The Promoter reserves the right to announce or publish the winner's name and/or photograph for publicity purposes. It is a Term and Condition of entry into this promotion that the winner will consent to the Promoter doing so. Eligible Entrants consent to the Promoter using the winner’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
